1. About the Platform

Aptcure is a technology marketplace operated by Aptcure Health Technologies that connects families navigating neurological recovery with independent rehabilitation providers for home-based care.

Aptcure is not a healthcare provider. Aptcure is not an employer of the rehabilitation providers listed on the platform. Aptcure facilitates the connection between patients/caregivers and independent professionals.

2. Eligibility

• You must be at least 18 years of age to create an account. If you are under 18, a parent or legal guardian must create and manage the account on your behalf.
• The platform is currently available to residents of India.
• By using Aptcure, you represent that you meet these eligibility requirements.

3. Your Account

• One account per phone number. Duplicate accounts may be merged or suspended.
• You are responsible for maintaining the security of your account credentials. Do not share your OTP or login details with anyone.
• You must provide accurate and complete information during registration and keep it updated.
• Aptcure Health Technologies reserves the right to suspend or terminate accounts that violate these terms or contain fraudulent information.

4. Services

The Aptcure platform facilitates the following:

• Matching patients/caregivers with verified rehabilitation specialists based on condition, location, language, and availability.
• Appointment booking and session scheduling.
• Delivery of personalised exercise plans with video guidance.
• Clinical assessment tracking using validated scales (Barthel, Tinetti, FIM, PHQ-9).
• Secure messaging between patients/caregivers and their care team.
• Payment processing for sessions and care packages.

6. Provider Relationship

• Rehabilitation providers on Aptcure are independent professionals, not employees, agents, or contractors of Aptcure Health Technologies.
• Aptcure verifies provider credentials (qualifications, registration numbers, identity) but does not supervise, direct, or control clinical decisions made by providers.
• The therapeutic relationship is between the provider and the patient/caregiver. Aptcure Health Technologies is not a party to this clinical relationship.
• Providers are solely responsible for the clinical care they deliver.

7. Booking and Payments

Session Rates

Session rates are set by individual providers and displayed before booking. All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.

Payment Processing

Payments are processed through the platform via UPI, debit/credit card, or net banking. Aptcure Health Technologies acts as a payment facilitator between patients and providers.

Cancellation Policy

• More than 24 hours before session — full refund.
• 2 to 24 hours before session — 50% refund.
• Less than 2 hours before session — no refund.

Refunds

Eligible refunds are processed within 7 business days to the original payment method.

8. Limitation of Liability

• Aptcure Health Technologies is not liable for clinical outcomes of rehabilitation care delivered by providers through the platform.
• Aptcure Health Technologies is not liable for any acts, omissions, negligence, or malpractice of providers.
• To the maximum extent permitted by applicable law, Aptcure Health Technologies's total aggregate liability to you for any claims arising from your use of the platform shall not exceed the total fees paid by you to Aptcure Health Technologies in the 3 months immediately preceding the claim.
• The platform is provided "as is" and "as available." We do not guarantee uninterrupted or error-free service.

9. User Obligations

By using Aptcure, you agree to:

• Provide accurate and truthful information about yourself and your family member.
• Not misuse the platform, including but not limited to creating fake accounts, submitting fraudulent claims, or interfering with platform operations.
• Not harass, abuse, or threaten providers, other users, or Aptcure Health Technologies staff.
• Comply with the instructions and recommendations of your assigned rehabilitation provider to the extent medically safe and reasonably possible.
• Not use the platform for any unlawful purpose.

10. Intellectual Property

• All platform content — including but not limited to the Aptcure name, logo, website design, app design, exercise library content, and assessment tools — is the intellectual property of Aptcure Health Technologies and is protected under Indian copyright and trademark law.
• Your personal data and health records belong to you. You grant Aptcure Health Technologies a limited licence to process this data solely for the purposes described in our Privacy Policy.
• You may not copy, reproduce, distribute, or create derivative works from any platform content without prior written permission from Aptcure Health Technologies.

11. Termination

• You may terminate your account at any time by contacting us at support@aptcure.com or through the app settings.
• Aptcure Health Technologies may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice.
• Upon termination, your data will be handled in accordance with our Privacy Policy, including the data retention and deletion provisions.
• Termination does not affect any rights or obligations accrued prior to termination, including outstanding payment obligations.

12. Dispute Resolution

• These Terms are governed by and construed in accordance with the laws of India.
• The courts in Bangalore, Karnataka shall have exclusive jurisdiction over any disputes arising from or related to these Terms or your use of the platform.
• Before initiating formal legal proceedings, both parties agree to first attempt resolution through good-faith mediation.
• If mediation fails, disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed mutually. The seat of arbitration shall be Bangalore.

13. Indemnification

You agree to indemnify, defend, and hold harmless Aptcure Health Technologies, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your misuse of the platform, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) any inaccurate information provided by you on the platform.
